Erística na decisão jurídica

O trabalho pretende definir o que se deve entender por teoria da argumentação jurídica, com foco no papel da erística e sua relação com os conceitos de persuasão – a que a argumentação jurídica é tradicionalmente reduzida – e decisão. A metodologia utilizada consiste em uma arqueologia etimológica ou fenomenologia conceitual dos conceitos principais, a partir da Grécia antiga, onde nasceu a retórica. O texto sugere também que a sociedade contemporânea complexa pulveriza seus centros de decisão e amplia o caráter erístico do discurso jurídico. E procura os fundamentos antropológicos da decisão erística na impossibilidade de distinguir a mentira na linguagem humana e consequente comunicação.
